JONESBORO, Ark. (KAIT) – A man accused of stealing ammo from a Jonesboro store faces a felony charge after police said he assaulted an officer who tried to stop him.
Craighead County District Court Judge David Boling found probable cause Wednesday to charge 21-year-old Barry Fitzgerald Davis with the following:
- Aggravated assault upon a law enforcement officer or employee of a state/local correctional facility, a Class D felony
- Obstructing governmental operations, a Class C misdemeanor
- Fleeing, a Class A misdemeanor
- Shoplifting $1,000 or less, a Class A misdemeanor
- Failure to use a turn signal
The charges stem from a June 27 report of shoplifters stealing ammunition from a local store.
According to the affidavit, when officers arrived, they saw the suspect driving east on Meador Road and followed it onto another street before conducting a traffic stop for failing to use any turn signals.
When the officer approached the vehicle, Davis reportedly said he had a firearm.
The court documents stated that after another officer arrived at the scene, Davis and a juvenile passenger refused to exit the vehicle.
As Davis was rolling up his window, the affidavit stated the first officer reached in to unlock the driver’s side door.
“Davis then grabbed the officer’s arm and put the vehicle in reverse,” the court documents stated. “He pulled backwards quickly, narrowly avoiding both officers. Davis then put the vehicle into Drive and sped off through a home’s front yard.”
Officers chased the vehicle until it reached a dead end on Mary Jane Street. Both suspects then got out of the car and ran from the scene.
On July 22, after a judge had issued a bench warrant for his arrest, task force officers with the U.S. Marshals Service contacted Davis, and he agreed to turn himself in to police.
He’s being held in the Craighead County Detention Center on a $25,000 cash/surety bond awaiting a Sept. 30 appearance in circuit court.
