A Miami-Dade man accused of fatally shooting another man who allegedly had a years-long affair with his wife appeared before a judge on Friday.
Omar Rene Aguila, 69, was arrested Thursday on charges of second-degree murder and possession of a firearm or weapon by a convicted felon, records showed.
During his court appearance, Aguila’s attorney argued that he should be released because the shooting was done in self-defense.
“According to the police report, Mr. Aguila told the police that the alleged victim was reaching down, he thought he was going to be shot,” his attorney said.
Ultimately, the judge denied Aguila’s bond.
The Miami-Dade Sheriff’s Office said that the shooting happened on July 12 at a shopping center in the 7900 block of Northwest 27th Avenue.
Deputies responded and found the victim in a vehicle suffering from multiple gunshot wounds. He was taken to Jackson Memorial Hospital, where he was pronounced dead.
As detectives continued to investigate, they found that since 2019, the victim had been having an affair with Aguila’s wife, the arrest report said.
In April of 2024, Aguila learned of the affair and warned his wife to end it.
Two days before the shooting, on July 10, the victim arrived at Aguila’s home to speak with his wife, and Aguila confronted him, and the victim left.
Following that encounter, Aguila, his wife and son were at the shopping center when the victim arrived and tried to speak with the wife.
Aguila then went to the victim’s car, where they both got into a verbal altercation, which led to Aguila pulling out a gun from his waistband and shooting the victim several times.
Surveillance video from the area captured the shooting, according to the report.
When deputies arrived, they found Aguila had a handgun and discovered four spent bullet casings.
Aguila was initially released pending further investigation, but investigators found no gun in the victim’s vehicle and determined that the victim was at the shopping center to deliver food to a friend who worked there, the report said.
