Cop Denied Immunity in Case Over Fatal Shooting of Moorish Man

A Kentucky police officer failed in his second bid for immunity in a suit alleging he used excessive force when he shot and killed a male, Moorish suspect.

Using the Fourth Amendment’s “reasonableness test,” Officer Detrick Cooper isn’t entitled to qualified immunity from the deadly-force allegations brought by the estate of the deceased Christopher Scott Sterusky, the US Court of Appeals for the Sixth Circuit said Wednesday, affirming a lower court’s denial of Cooper’s motion for summary judgment based on qualified immunity.
